📄 Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of GainFuelAI. By creating an account, purchasing a subscription, or otherwise using GainFuelAI, you agree to these Terms and the GainFuelAI Privacy Policy.

🎂 1. Eligibility

You must be at least 14 years old to create a GainFuelAI account.

If the law in your country requires a higher minimum age or authorization from a parent or legal guardian, you may use GainFuelAI only after satisfying that requirement.

You must provide accurate information during registration and must not create an account on behalf of another person without authorization.

🔐 2. Account Registration and Security

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• Using a strong and secure password.
• Keeping your email and profile information accurate.
• All activity performed through your account.
• Informing GainFuelAI support if you suspect unauthorized access.

You must not sell, transfer, share, or provide unauthorized access to your account.

GainFuelAI may require email verification or another authentication step before allowing access to certain features.

🏃 3. Purpose of GainFuelAI

GainFuelAI provides general nutrition, fitness, hydration, workout, progress-tracking, meal-planning, and AI-assisted informational features.

GainFuelAI does not provide medical care and is not a healthcare provider.

The app is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

✨ 4. AI-Generated Information

GainFuelAI may use artificial intelligence to:

• Generate meal ideas.
• Estimate calories and macronutrients.
• Analyze food images.
• Provide nutrition suggestions.
• Personalize supported recommendations.

AI-generated information may be incomplete, inaccurate, outdated, or unsuitable for a particular user.

Food-scanning results are estimates and may vary based on image quality, ingredients, serving size, preparation method, and other factors.

You are responsible for reviewing AI-generated information and deciding whether it is appropriate for you. GainFuelAI does not guarantee specific health, weight, fitness, or nutritional results.

✅ 5. Acceptable Use

You agree not to:

• Use GainFuelAI for illegal, fraudulent, harmful, or abusive activity.
• Attempt to access another user's account or data.
• Circumvent subscription restrictions or entitlement checks.
• Interfere with app security, servers, databases, or networks.
• Reverse engineer or attempt to extract protected source code except where applicable law expressly permits it.
• Upload malicious software, illegal content, or content that infringes another person's rights.
• Harass support personnel or other users.
• Misrepresent reviews or submit fraudulent ratings.
• Use automated systems to scrape, overload, or disrupt the service.
• Resell or commercially exploit GainFuelAI without written permission.

We may restrict or suspend access when reasonably necessary to protect users, the app, or our legal rights.

📷 6. User Content, Photos and Reviews

You retain ownership of content you submit, including support messages, photos, videos, reviews, and feedback.

By uploading content, you grant GainFuelAI a limited, non-exclusive license to store, process, reproduce, and display that content only as reasonably necessary to operate the feature, provide support, display a submitted review, protect the service, and comply with law.

You confirm that:

• You own the content or have permission to submit it.
• The content does not violate another person's privacy or intellectual-property rights.
• The content is not illegal, threatening, hateful, deceptive, or malicious.
• You will not upload sensitive information that is unnecessary for the feature.

Public reviews may be visible to other users. Support messages are intended for communication with authorized GainFuelAI personnel.

We may remove content that violates these Terms or applicable law.

🏅 7. Free, Silver and Premium Plans

GainFuelAI may offer Free, Silver, and Premium access levels with different features and usage limits.

Available features, meal limits, programs, AI access, workout access, advertisements, and other benefits may vary by plan and platform.

The current price, billing period, included benefits, and renewal information are displayed before purchase.

GainFuelAI may update plan features prospectively. Material subscription changes will be disclosed as required by applicable store policy and law.

🔁 8. Subscriptions and Automatic Renewal

Paid subscriptions may be offered monthly or yearly.

Subscriptions are processed by Google Play or the Apple App Store and normally renew automatically at the beginning of each billing period unless cancelled through the applicable store before renewal.

The store account used for the purchase will be charged according to the price and billing period displayed during checkout.

Prices may include or exclude taxes depending on the store, country, and applicable law.

GainFuelAI does not directly receive or store complete payment-card information.

🔎 9. Subscription Verification

Paid features become active only after the applicable store and GainFuelAI servers successfully verify the purchase.

Verification may take additional time when:

• The device is offline.
• The store has not completed the transaction.
• The subscription is pending.
• Payment verification is delayed.
• The subscription is in a grace period or account-hold state.

You will not be asked to purchase the same subscription again solely because verification is temporarily delayed.

✕ 10. Cancelling a Subscription

You may cancel through the subscription-management section of Google Play or the Apple App Store.

Cancelling normally:

• Stops future automatic renewals.
• Does not automatically refund the current billing period.
• Allows paid benefits to continue until the end of the verified paid period, unless the store confirms an earlier refund, revocation, or immediate cancellation.
• Does not delete your GainFuelAI account.

↩️ 11. Refund-Support Requests

GainFuelAI allows users to submit a refund-support request for their latest verified purchase or renewal within seven days of that charge.

Submitting a request does not guarantee that a refund will be approved.

Refund eligibility and processing may depend on:

• The applicable app store's policies.
• The reason for the request.
• Purchase and account verification.
• Whether the charge has already been refunded.
• Local consumer-protection law.
• The status of the subscription and entitlement.

A refund-support request normally applies only to the latest eligible charge. Older charges are not automatically included.

Cancelling a subscription does not automatically issue a refund.

When a refund is approved, access may be revoked or the account may be downgraded according to the refunded purchase and store confirmation.

Users may also exercise any separate refund rights provided by Google Play, Apple, or applicable law.

♻️ 12. Restoring Purchases

The Restore Purchases feature attempts to recover eligible active purchases associated with the user's current Google Play or Apple account.

Restoration does not:

• Create a new charge.
• Restore expired or refunded subscriptions.
• Transfer purchases between unrelated store accounts.
• Guarantee access when the store cannot verify ownership.

A purchase is restored only after successful store and server verification.

⇄ 13. Plan Changes

Upgrades, downgrades, and billing-period changes may be processed immediately or at the next renewal date depending on the applicable store's rules and the selected change.

Google Play or Apple may determine:

• When the plan change becomes effective.
• Whether proration or credit applies.
• The amount charged.
• The next renewal date.

Changing plans does not automatically issue a refund.

The app will update the user's entitlement only after the store and GainFuelAI servers verify the change.

📢 14. Advertising and Promotions

The Free plan may display GainFuelAI advertisements, promotional cards, sponsorship messages, or upgrade offers.

Paid plans advertised as ad-free will not display regular GainFuelAI advertising while the applicable paid entitlement remains active, although essential account, subscription, safety, legal, and service announcements may still appear.

© 15. Intellectual Property

GainFuelAI, including its branding, interface, software, original text, designs, graphics, databases, and app-created content, is owned by or licensed to GainFuelAI and is protected by applicable intellectual-property laws.

These Terms provide a limited, personal, revocable, non-exclusive, and non-transferable right to use GainFuelAI for its intended purpose.

You may not copy, redistribute, sell, sublicense, or commercially exploit protected GainFuelAI content without written permission.

AI-generated outputs may not be unique and similar content may be generated for other users.

🗑️ 16. Account Deletion

Users can request permanent deletion inside the app through:

Profile → Delete Account

After confirmation, the request is submitted immediately to the GainFuelAI administration team. Administrative review is used to verify and safely complete the deletion.

Once approved, the account and associated personal data are normally permanently deleted within 24 hours, subject to limited legal, accounting, transaction, security, fraud-prevention, dispute, and backup-retention requirements.

Account deletion is permanent after completion and cannot be undone.

Account deletion may not automatically cancel an app-store subscription. Users should cancel through the applicable store before or after submitting the deletion request.

🌐 17. Service Availability and Changes

We work to keep GainFuelAI available but do not guarantee uninterrupted or error-free operation.

Features may occasionally be unavailable because of:

• Maintenance.
• Network or provider outages.
• Store-verification delays.
• Security incidents.
• Technical problems.
• Legal or regulatory requirements.
• Changes made by third-party service providers.

We may modify, replace, suspend, or discontinue features when reasonably necessary. We will provide notice of material changes where required.

⛔ 18. Suspension and Termination

GainFuelAI may temporarily restrict or permanently terminate an account when reasonably necessary because of:

• A serious or repeated violation of these Terms.
• Fraudulent purchases or refund abuse.
• Unauthorized account access.
• Security threats.
• Illegal or harmful activity.
• A valid legal requirement.

Where appropriate and legally permitted, we may notify the user and provide an opportunity to contact support.

⚠️ 19. Disclaimers

GainFuelAI is provided on an “as available” basis to the extent permitted by law.

We do not guarantee:

• Specific weight, muscle, health, or fitness results.
• That nutrition estimates are completely accurate.
• That AI output will always be correct.
• That every feature will be available on every device.
• That the service will operate without interruptions or errors.

Nothing in these Terms excludes rights or protections that cannot legally be excluded under applicable consumer law.

⚖️ 20. Limitation of Responsibility

To the maximum extent permitted by law, GainFuelAI is not responsible for indirect, incidental, or consequential loss resulting from reliance on estimated nutrition information, AI-generated content, user misuse, device failure, third-party outages, or unauthorized account access outside our reasonable control.

This section does not limit liability that cannot legally be limited.

🔒 21. Privacy

Use of GainFuelAI is also governed by the GainFuelAI Privacy Policy, which explains how information is collected, used, stored, protected, retained, and deleted.

The Privacy Policy can also be opened from the Support section of the Profile screen inside GainFuelAI.

📝 22. Changes to These Terms

We may update these Terms to reflect changes in GainFuelAI, subscription offerings, service providers, legal requirements, or security practices.

Updated Terms will be published with a revised “Last updated” date.

Where legally required, we may provide additional notice or request acceptance before materially revised Terms take effect.

Continued use after an update constitutes acceptance only to the extent permitted by applicable law.
